Access to archaion.com is permitted during its operation, but the company reserves the right to interrupt or withdraw its Services without prior notice. The company bears no responsibility in the event of inability to access all or part of the services for any reason.

In no case is it responsible, liable or guaranteed regarding the security and content. Not to make false or fraudulent orders. If we reasonably believe that such an order has been submitted, we have the right to cancel it and inform the competent authorities.

Please provide us with your correct and accurate e-mail address, postal address and/or other contact details.

You also accept that we may use this information to contact you if necessary. If you do not provide us with all the information we need, we cannot process your order.

By submitting an order through the website, you guarantee that you are at least 18 years old and that you have the legal capacity to enter into binding contracts.

4 | SALES AGREEMENT – ORDERING PRODUCTS

The information contained in the Terms of Use and the details contained in archaion.com do not constitute an offer to sell but an invitation to information.

No contract shall be deemed to have been formed between us and you in respect of any products until your order has been expressly accepted by us. If we do not accept your order and the funds have already been deducted from your account, then these will be refunded in full without interest.

To place an order you will be asked to follow the purchase process and click the “COMPLETE” button. You will then receive an e-mail from us confirming receipt of your order (“Order Confirmation”). Receipt of the email confirms the completion of the order and its acceptance by us.

5 | PRODUCT AVAILABILITY

All product orders are subject to availability. In this light, in case of supply difficulties or exhaustion of products in stock, we reserve the right to inform you either by telephone at the number you have stated or by email, about similar products of equal or higher quality and value, which you can order. If you do not wish to order such similar products, we will refund you the amount you may have paid in full, without interest.

6 | ORDER REJECTION

We reserve the right to withdraw any product from archaion.com at any time and/or

to remove or edit any material or content on this website. Although we make every effort to process all orders submitted to us, exceptional circumstances may arise in which we may need to refuse to process an order after we have already sent you the Order Confirmation, which we reserve the right to do at any time in our absolute discretion.

We shall have no liability to you or to any third party for the withdrawal of any products from this website, as well as for the removal or editing of any material or content on the website or for the refusal to process or accept an order after we have sent you the Order Confirmation.

7 | DELIVERY – NON-DELIVERY OF PRODUCTS

Subject to clause 5 above, regarding product availability and subject to exceptional circumstances, we will use our best efforts to complete your order for the product(s) listed in the Order Confirmation by the delivery date specified in the Order Confirmation or, if no delivery date is specified, within the estimated time period indicated when you select a payment method, and in any event no later than 30 days from the date of the Order Confirmation. The delivery of the products is carried out through our partner carrier and their shipping time in Greece is between three and four (3-4) business days from the day following the Order Confirmation. We do not deliver on Saturdays and Sundays.

However, delays may occur in cases such as , depending on the delivery area or in unforeseen circumstances.

If for any reason we are unable to meet the delivery date, we will inform you and offer you the option to either continue shopping by setting a new delivery date on our part, or to cancel the order with a full refund without interest.

For the purposes of these Terms, “delivery” will be deemed to have taken place or the order will be deemed to have been delivered when you or a third party on your behalf, other than the carrier, has acquired physical possession or control of the products, which will be evidenced by signing the receipt of the order at the agreed delivery address.

If it becomes impossible for the carrier to deliver your order, it will leave you a note explaining where your order is and what you need to do to collect it and will also contact you by telephone. If, after 10 days from the moment your order is available for delivery, the said order has not yet been delivered for reasons not attributable to our fault, we will consider that you wish to cancel the Contract and the Contract will be deemed to have expired. As a result of the termination of the Contract, we will refund to you, without interest, any payment we have received from you, as soon as possible and in any case within 14 days from the date on which the Contract has expired.

In the event of loss of your order due to the carrier’s error, we will inform you thereof and, if you still wish to complete the order, we will arrange for the replacement and re-sending of the same products to you, otherwise we will refund to you, without interest, any payment we have received from you.

8 | PAYMENT FOR PRODUCTS

The price of each product is that set at any time on archaion.com, except in cases of obvious error. We always take care to ensure that all prices on the website are accurate, however errors may occur. If we discover an error in the price of any product you have ordered, we will inform you as soon as possible and give you the opportunity to reconfirm the order at the corrected correct price or to cancel it. If we are unable to contact you, we will treat your order as cancelled and refund you in full any amount you have paid.

We are not obliged to supply you with any product at the incorrect lower price (even if we have sent you the Order Confirmation) where the error in the price is obvious and undisputed and can reasonably be recognised by you as an incorrect price.

The prices on our website include VAT but do not include delivery charges, where you are charged Delivery Charges.

Based on our company’s policy, shipping costs for your purchases within the Greek territory over fifty euros (50€) are free for you, while for purchases under fifty euros (50€) you are charged

the amount of three euros and ninety cents (3.90€). Shipping costs for your purchases within the European Union are free for purchases over one hundred euros (100€) while for smaller purchases you are charged ten euros (10€). Finally, for shipping costs for purchases outside the European Union you are charged thirty euros (30€) regardless of the value of the purchased products. In particular, international shipments are made with ELTA. Prices may change at any time, however, subject to the specific provisions immediately above, any changes will not affect orders for which you have already been sent an Order Confirmation.

Once you have selected all the products you wish to purchase, they will have been added to your shopping cart and the next step is to proceed with the order and pay. To do this, you must follow the steps of the purchase process, completing or verifying the information requested at each step. Furthermore, during the purchase process, before payment, you can change your order details.

Payment can be made via cash on delivery, with Visa, Mastercard and American Express credit cards.

To minimize the possibility of unauthorized access, your card details will be encrypted. Your card will only be charged if your order is shipped for delivery from our warehouses.

At the moment you press the “Complete order” button, you confirm that your credit card is valid and has sufficient funds. Credit cards are subject to validity and approval checks by your card issuer. If your card issuer does not approve the payment, we are not responsible for any delay or non-delivery and we will not be able to conclude a Contract with you.

9 | INTELLECTUAL AND INDUSTRIAL PROPERTY RIGHTS – TRADEMARKS

It is noted that according to Law No. 2121/1993 (as amended and in force today), the Berne Convention (ratified by Law 100/1975) and the relevant provisions on the protection of intellectual property on the Internet, any form of copying, modification, intervention, transfer, distribution, resale, rental, republication, reproduction, retransmission in electronic or mechanical form, storage, printing, creation of a derivative work, downloading by anyone or misleading the public regarding the actual carrier of the content is expressly prohibited.

The content of archaion.com does not constitute and in no case should it be construed as granting an express or implied license or right to use any Trademark appearing therein without the written permission of the Company or third parties who may own the Trademarks appearing therein. The trademarks, logos, distinctive features that appear on archaion.com and the depictions of persons or places or things that form part of its content are the property of the Company or third parties. Their use is strictly prohibited without obtaining prior written permission from the Company, unless otherwise provided in the applicable terms of use.

Products, services, names, trademarks or distinctive features of third parties that appear on archaion.com are the intellectual and industrial property of third parties, who also bear the relevant responsibility.

Information submitted to the company through archaion.com is considered non-confidential information and does not constitute an asset of the user in question. 10 | COMPANY LIABILITY

These specific terms and conditions as well as any amendments thereto are governed by and interpreted in accordance with Greek law. For any dispute arising from the use of archaion.com, the competent courts of Kalamata have jurisdiction.
